Planning with Non-Traditional Families: What we all need to know.

The law provides a legally married couple with a basic estate plan - intestacy provides that a spouse, and possibly children, will inherit, and the spouse will be named in most every fiduciary capacity required. This includes first choice as guardian, in the event of disability, and as personal representative (or executor). A couple who is legally unmarried, however, has to affirmatively act to secure any rights whatsoever for one partner to another, and in some situations, all the documents in the world can't secure for the partner what a legal spouse gets as of right.
